The Louisiana Department of Revenue (LDR) is responsible for fairly and efficiently collecting state tax revenues to fund public services, to regulate charitable gaming and the sale of alcoholic beverage and tobacco, and to support state agencies in the collection of overdue debts.
Collectively, each program, unit, division and group work together to provide the core services to taxpayers of the State of Louisiana and stakeholders of the agency.
LDR is comprised of the following groups: Tax Collection, Charitable Gaming, Alcohol and Tobacco Control (ATC), Debt Recovery and Louisiana Tax Free Shopping Commission.
The Litigation Division is responsible for representing the Department in litigation before the courts and the Board of Tax Appeals.
In addition, the division provides legal advice and services to executive management, other departmental divisions and governmental agencies.
Division functions include litigation, mediation and formal settlement negotiations and participation in taxpayer conferences.
ABOUT THIS POSITION: The incumbent in this position litigates highly sensitive and high profile complex precedent cases in state and federal trial court, state and federal appellate court, federal court including federal bankruptcy court, and the Board of Tax Appeals with very little to no supervision from a higher-ranking attorney.
Duties include, but are not limited to: Assists the agency in reviewing and submitting input regarding highly sensitive and high profile complex and precedent proposed and current legislation, which affects specific areas of tax.
Assists in researching laws, agency policies and interpretations of judicial decisions and providing legal advice on such to the Division Director and any other appropriate departmental personnel.
Performs administrative duties related to individual income; corporation income and franchise; sales and use; severance; natural gas franchise; excise; and legal administrative case inventories and special projects.
Participates with higher-ranking Attorneys to develop and conduct Department wide training on legal research, law or evidentiary matters.
Attends training courses to enhance legal skills and knowledge of advanced level tax laws, procedural and evidentiary laws, regulations, policies and procedures.
Performs other duties as assigned by the Legal and/or Executive Management Team.

Conducts pre-trial conferences with the attorneys to resolve preliminary issues and narrow the scope of the hearing to the facts actually in dispute.
Determines if there are jurisdictional or procedural issues to be disposed of and if so, decides the most appropriate manner (i.
e.
a limited hearing, an order to brief the issue, an order to amend the pleadings, a status conference, etc.
) to address these issues.
Secures, compiles, and maintains all records of adjudications.
Ensures that accurate records are maintained in the proceedings that evidence is properly marked and included in the case record, and that audio recordings are accurately marked and properly indexed and stores.
Conducts a continuous study of the current statues, regulations and case law related to areas of law for which hearings are assigned.
